New York’s “No-Fault” System
New York has what is known as a “no-fault” system, which is intended to speed up the payment of life expenses such as medical expenses, wages, prescriptions, household bills, and mileage reimbursement caused by accidents. Instead of waiting for the outcome of lawsuits to determine who is at fault, insurance companies are required to pay up to $50,000 toward the losses mentioned previously regardless of who caused the auto accident. In order to secure your no-fault benefits, you must complete and return a no-fault application within 30 days from the date of the accident.
No-fault does not cover vehicle damage and does not extend past $50,000 unless you have additional coverage known as APIP or OBEL. A lawsuit can still be brought for additional coverage or for damages such as pain and suffering.
