What signs to look for if you suspect nursing home abuse.

If you suspect that your loved one has been a victim of some form of nursing home abuse or neglect, it is important that you take immediate action.

Many of the nursing home employees are often underpaid, overworked and unfortunately poorly trained. Neglect and abuse may occur when an elderly person does not receive the proper level of care he or she requires. Should a nursing home fail to provide the proper care that they have promised, a resident can often suffer from physical and/or psychological harm. It is important that you are aware of potential signs that your loved one has been harmed in order to prevent or stop it before your loved one suffers from needless harm.

Below are some signs of nursing home abuse.

  1. Open wounds
  2. Bed/pressure sores
  3. Sudden and unexplained change in weight
  4. Poor personal hygiene, smell of urine or feces, soiling
  5. Recurrent infection
  6. Sudden loss of hair
  7. Emotional withdrawal
  8. Physical issues from lack of nutrition
  9. Loss or decrease in mobility
  10. Unexplained injuries
  11. Fractures

Knowing the warning signs of abuse can save your loved one from wrongful death or unnecessary harm.

If you suspect a nursing home is not providing the level of care that they promised, contact the New York State Department of Health at 1-888-201-4563 or www.health.ny.gov/facilities/nursing/complaints.htm.

Jeffrey G. Pomeroy, managing partner at Greene & Reid, obtained a 1.2 million dollar settlement for a client involved in a motor vehicle collision in Jefferson County. The client was injured when the vehicle he was a passenger in lost control, exited the roadway and struck a tree head on. The client, who was 28 years of age at the time of the collision, sustained a C2 vertebral fracture, a concussion and a low back injury. The client underwent several years of treatment and rehabilitation as a result of his injuries and has been left with disabling and permanent injuries. Prior to commencing the lawsuit, the insurance carrier offered $75,000.00 to settle the case. After a few years of litigation, Greene & Reid was able to successfully negotiate a settlement for 1.2 million dollars to compensate the client for his losses relative to his past and future pain and suffering and economic losses.

On March 8, 2017, Jeffrey G. Pomeroy, managing partner at Greene & Reid, successfully obtained a jury verdict against UHS Hospital in the amount of $200,000.00. The case involved a 69 year old woman who sustained pelvic fractures from a fall while attempting to open an electronic metal door to the emergency department at UHS Hospital in Binghamton, New York. Prior to this incident, the hospital removed the push plate to electronically open the emergency room doors without posting any warning signs thereby creating a dangerous condition to our client and other visitors and patients of the hospital. The hospital refused to make any offers to settle the lawsuit and on March 8, 2017, the jury awarded our client $200,000.00 to compensate her for past and future pain and suffering.
